Guide debt collection services
Pursuant to the Wet kwaliteit incassodienstverlening, the Besluit kwaliteit incassodienstverlening and the Regeling kwaliteit incassodienstverlening, debt collection service providers are obliged to proactively inform you of your rights and obligations. In this leaflet, we set out your rights and obligations. Collection service providers affiliated through NowID can be reached both physically and by telephone. They offer you the opportunity to make a physical appointment at their office for (for example) obtaining information, submitting documents or making (pin) payments. Make an appointment in advance. Why am I receiving a reminder?
You are receiving a demand letter because a party claims that you owe a sum of money and have not paid the amount, despite previous reminders. More information about the claim is provided in the demand letter. The debt collection service provider can give you further details on how the claim originated. For any questions regarding the claim, please contact the debt collection service provider.
Payment options
You have several payment options:
iDEAL: If you would like to pay via iDEAL, please contact the collection service provider. They will generate a personal iDEAL link for you, allowing you to make a secure payment.
Bank Transfer: Prefer to make the payment yourself? You can transfer the amount directly through your online banking. Be sure to send the payment to the collection service provider’s bank account number.
Cash: While cash payments are generally avoided, you can pay in cash by scheduling an appointment with the collection service provider. Please note that you will be asked to explain the origin of the cash. This explanation will be recorded in their system.
I would like to arrange a payment arrangement
By law, creditors are not required to accept a payment arrangement (Article 6:29 BW). However, debt collection service providers affiliated with NowID make every effort to encourage their clients to agree to realistic payment arrangements that take your financial situation into account. Contact the debt collection service provider to discuss your payment plan options. Keep in mind that they may request a statement of your income, expenses, and debts.
I dispute the claim
The moment you dispute the claim, you can make this known by contacting the collection service provider. At that point, the collection process will be paused. The collection service provider will then contact the client to discuss your dispute. You will then receive a response from the debt collection service provider or its principal within a reasonable period of time.
I have more debts
It is important to get a grip on the number of outstanding bills. There are various websites with advice, tips and information that can be helpful in getting your finances back in order. On www.nibud.nl and www.zelfjeschuldenregelen.nl you will find many tips and tools.
Is there a problematic debt situation? For help with your debts, you can contact your municipality. You can go there for advice or an application for debt mediation or debt restructuring. The municipality will see if it can help you with your debts. This is called an amicable process. Read more information here.

I have a complaints
Debt collection service providers affiliated through NowID do their best to provide a proper service. However, complaints may still arise. If you have a complaint about the service, inform the debt collection service provider. They will then deal with your complaint in accordance with the standard complaints procedure that you can find on their website. You can submit your complaint in writing by post or e-mail.
If you are not satisfied with the handling of your complaint after it has been dealt with, you have the option of submitting a complaint to Incassoklacht.nl. Incassoklacht.nl will handle the dispute using their dispute resolution scheme. Read more information here.
Processing personal data
For the sake of completeness, please note that the data you provide in connection with the underlying agreement(s) will be included in the records kept by the debt collection service providers. These personal records are kept for the purpose of administering relevant data relating to the collection of the claim(s). The General Data Protection Regulation applies to these records.
Would you like the debt collection service provider to delete your personal data? Then send an e-mail or letter to the organisation. In it, specify which data you want to be deleted. You can use the sample letter deleting data from the Personal Data Authority for your request. You can find the sample letter here. In some cases, the debt collection service provider does not (yet) have to remove your personal data because (for example) there is still an outstanding debt. Read more information here.
Voluntariness
You have no obligation to speak to the debt collection service provider or allow her into your home. You may end the conversation with a debt collection service provider at any time. Ending a conversation may have consequences (read: what happens if I don’t pay?).
What happens if I don't pay?
If you do not pay the claim, the creditor may choose to start legal proceedings. In that case, your file will be transferred to the bailiff. You can read more about this procedure and the possible consequences here.
